The CLOUD Act (Clarifying Lawful Overseas Use of Data Act) is an American federal law from 2018 that gives American authorities the right to demand access to data managed by American companies, regardless of where that data is physically stored. This creates a direct conflict with the European GDPR. In June 2025 Microsoft testified before the French Senate that it could not guarantee the protection of data of French citizens. According to the DLA Piper GDPR report of 2025, fines for violations with cross-border data transfers increased by 18% compared to the previous year.

A common mistake is equating data residency (where your data physically is) with data sovereignty (which legal system has authority over it). That your data is in a European data center does not automatically mean it falls under full European jurisdiction. If the provider has an American parent company, the CLOUD Act may still apply.
